Preparing and Submitting Comments on a Draft Environmental Impact Report (DEIR)
Process: Under the California Environmental Quality Act (CEQA), a proposed development, unless determined exempt, is subject to a full and complete disclosure to the public of how the project affects the environment. CEQA requires that the project applicant disclose environmental impacts of the project, evaluate feasible alternatives, and comment to reasonable and feasible mitigation measures if there are significant impacts.
Under the principle of CEQA, a proponent cannot create an impact without mitigating for it. In other words, a project must not contribute individually or cumulatively to the degradation of the California environment.
Of course your comments can be as brief as “I object to this development” but if comments are posed in the form of a question, the applicant must address that inquiry in the Final Environmental Impact Report (FEIR). Therefore, questions and substantive comments are preferable.
Your comments should also relate to the project at large and how it affects the community, not how it affects an individual house or property.
Provide Background: Provide as much background information to support your conclusion of your claim as possible. For instance, detail existing traffic problems or highlight key intersections. State the basis for your opinion, such as if you have lived in a particular community for a great length of time, pass by a certain intersection frequently, or have utilized a particular space.
Support Your Argument: The DEIR is loaded with assumptions. You may pick apart the reasoning or findings behind any a findings or assumptions in the DEIR and detail any weaknesses. Provide relevant information and reasonable inferences to support your conclusion.
Potential Impacts to Address
- Traffic in term of counts, cut-through impacts, mitigations, parking, circulation, neighborhood impacts
- Air quality impacts during construction
- Visual impacts (blight, billboards, lights)
- Noise during and after construction
- Environmental changes/adverse effects
- Wildlife impacts
- Population impacts
- Impacts to resources and utilities – water, public services, emergency services, schools and the burdens of infrastructure
- The lost of the historic back lot and its loss as a production zone (with production jobs)
- The timing of the project and impacts beyond the 20 year development phase
- The placement of the residential development miles away from the MTA site
- The bifurcation of this project with the MTA FEIR and the cumulative impacts
